Our Terms and Conditions

Please read our terms carefully, they constitute a legally binding agreement.

Definitions

The term “Owner” refers to the owner or representative of the rental property. The terms “You”, “Your”,  “Yourself”, “Client” and “Rental Client” refers to the person booking the rental property. The term “Simply Escapes” refers to Simply Escapes Ltd.

Us

Simply Escapes Ltd is a fully registered UK company. Our registered address is 34 Squirrel Chase, Hemel Hempstead, HP1 2TL and our Company Registration No is 10231609.

Simply Aquitaine is a trading name of Simply Escapes Ltd and www.simplyaquitaine.com is a rental marketing portal of Simply Escapes Ltd.

Using our website

By using or accessing our websites, www.simply-escapes.com  and www.simplyaquitaine.com, you acknowledge and accept without qualification that you are subject to the following terms and conditions. Please stop using these websites immediately if you do not fully agree to these terms.

Our service

Simply Escapes is not a rental agency or a travel agent. We are a marketing agent and as such purely market properties for individual owners, with the aim of introducing rental clients. Any contract for the rental of any of the properties on our site is strictly between the owner of the property and yourself. Simply Escapes does not enter into the transaction between you and the owner. Should a dispute arise between yourself and the owners, we are unable to enter into any negotiations with either party concerning the dispute. Further, you hereby agree to release and discharge us from all liabilities, claims and expenses which arise out of or in connection with that dispute. Each owner has their own Booking Form and Terms and Conditions for their rental property. Please make sure you read these Terms and Conditions in full and that you are in full agreement with them before signing the Booking Form accepting the Terms and Conditions.

Accuracy

Although great care has been taken in compiling the information included in our websites, Simply Escapes will not be held liable for any inaccuracy, mistakes, omissions, mis-interpretation or disputes that arises from the material on our websites . All information about each property and each local area has been approved by the individual owner as accurate for the purposes of any rental agreements that may be entered into through this website.
If you feel any content within the site is misleading, please inform us straight away. We will investigate and rectify this if it is appropriate. You are solely responsible for ensuring the accuracy of any property descriptions and if you wish to contact the owner directly to clarify or make any enquiries, we are able to give you their contact details at any point. After this and only after this. It is for you to decide whether you wish to enter into a rental contract with the property owner. Simply Escapes does not represent, recommend or warrant any of the individual properties.

Please be aware that our portfolio of holiday rental properties offer (unless under our Hotel Breaks section) private accommodation that is being let for self-catering holidays and weddings. You therefore accept that these rental properties are not hotels or other types of  properties  that have obtained an International Class or category and should not be assessed as such. These rental properties are private homes and their standards and decor are individual and personal to each owner.

Simply Escapes solely introduces rental clients to the property owner, we are not authorised to undertake management or maintenance of any property, further, we are not responsible or liable for the property management or maintenance undertaken by the owner or by managers acting on his behalf.

Booking Terms and Conditions

Booking terms and conditions apply to individual properties and these will be provided to you before payment of the deposit. Each owner will provide you with a Booking Form to be completed after you have fully read their  Terms and Conditions. Do not enter into a contract with the property owner without reading their Terms and Conditions in full and accepting them in their entirety. In general, each owner asks for a 30% non-refundable deposit and then the remainder plus the breakage deposit becomes due 12 weeks prior to the holiday date. Please check each individual property page for their specific requirements.

When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between you and the owner. Following your booking via our online reservation system, you will be sent the owner’s Terms and Conditions and the owner’s Booking Form. You must read in full the Terms and Conditions  and sign the Booking Form to accept these conditions as well as making the deposit payment. . A contract between you and the owner shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent to you by post or email

Any Complaints 

If you are not satisfied with any aspect of the property rental, please inform the owner or their representative as soon as possible and always before departure from the rental property so that any issues can be resolved where at all possible. Where a dispute is not possible to resolve before departure, any issues must be taken up with the owner or owners representative, in writing, within 7 days of departure. Simply Escapes is not authorised to enter into any correspondence regarding complaint issues but we ask that you make us aware of any on-going dispute and the reasons for it. Please be aware that owner and Simply Escapes cannot be held responsible for any cessation of supply in public services such as electric, water, gas, telephone or internet.

Your Security Deposit

Any dispute regarding your security deposit must be addressed to the owner or the owner’s representative. Simply Escapes is unable to enter into discussions or correspondence regarding breakages, losses or damage caused to the rental property  as we are not present on site to assess the condition of the rental property before or after your holiday rental. Please be aware that any breakages, loss or damage during the rental period or indeed additional cleaning required after your rental period will result in deductions from your security deposit. In addition, the Client remains liable for the full costs of replacements or repairs which are not limited to the amount of the Security Deposit. You are fully entitled to require an invoice and receipts itemising any deductions.

Copyright and Downloading of Information from our Website

The entire contents of our website is protected by copyright law. All text, files, images, photos, maps and other materials on the Site are only for your personal use. These may be downloaded for your own personal use only and you acknowledge that by doing this you do not gain ownership of this material.
Copying or storing of any content for other than for your personal, non-commercial use is expressly prohibited without the prior written permission from us, Simply Escapes.
Privacy. We will not share personal information provided to us with any third party. This information will be used solely by Simply Escapes and its associates.

Insurance and Travel Arrangements

Fully comprehensive travel and holiday insurance is essential and should include but not be limited to cancellation cover, personal liability cover, personal belonging cover and accidental damage cover.
Please arrange your policy as soon as you have booked your property.  Please do not finalise travel arrangements until you have received written confirmation of your booking.

Swimming Pools

All Swimming pools within France are required to conform to AFNOR safety standards. A pool owner must ensure that they are using at least one of the approved safety devices which include barriers/fences, alarm systems and safety covers. It is the responsibility of the property owner to comply with these regulations. If you become aware of any default in these standards, you must inform the owner as soon as possible so that repair, replacement or indeed as a final resort, pool closure can take place.
